Welcome to Health.AI. By accessing or using our platform, mobile applications, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Eligibility
You must be at least 13 years old to use Health.AI. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Services with the supervision and consent of a parent or legal guardian who agrees to be bound by these Terms.
By using Health.AI, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into these Terms.

Health.AI IS NOT A MEDICAL PROVIDER AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR PROFESSIONAL HEALTHCARE SERVICES.
Our AI-powered platform provides general health information and insights based on medical datasets, but this information:
- Is for informational and educational purposes only
- Should NOT replace professional medical advice, diagnosis, or treatment
- May not be accurate, complete, or suitable for your specific health condition
- Should NOT be relied upon for medical emergencies
ALWAYS seek the advice of your physician or other qualified healthcare provider regarding any medical condition, symptoms, or treatment. Never disregard professional medical advice or delay seeking it because of information provided by Health.AI.

4. Account Registration & Security
4.1 Account Creation
To access certain features, you must create an account by providing accurate, current, and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Keeping your account information up-to-date
4.2 Account Termination
Health.AI reserves the right to suspend, terminate, or refuse service to any account at any time, with or without notice, for violations of these Terms, fraudulent activity, or any other reason we deem appropriate.
5. User Content & Data
5.1 Your Content: You retain ownership of all health information, data, and content you submit to Health.AI ("User Content"). By using our Services, you grant Health.AI a limited, non-exclusive, royalty-free license to process, analyze, store, and display your User Content solely to provide and improve our Services.
5.2 Prohibited Content: You agree not to submit content that:
- Is false, misleading, or fraudulent
- Violates any law or regulation
- Infringes on intellectual property rights of others
- Contains viruses, malware, or harmful code
- Harasses, threatens, or harms others
5.3 Data Usage: We may use aggregated, de-identified data derived from User Content for research, analytics, and product improvement. This aggregated data does not identify you personally.
6. Subscription & Payment Terms
6.1 Free and Premium Tiers
Health.AI offers both free and paid subscription tiers. By subscribing to a Premium plan, you agree to pay all applicable fees as described on our Pricing Page.
- Billing: Subscriptions are billed in advance on a monthly or annual basis
- Auto-Renewal: Subscriptions automatically renew unless you cancel before the renewal date
- Price Changes: We may change subscription prices with 30 days' notice
- Refunds: 30-day money-back guarantee for new subscribers (see our refund policy)
6.2 Cancellation
You may cancel your Premium subscription at any time through your account settings. Upon cancellation, you will continue to have Premium access until the end of your current billing period. No refunds will be provided for partial subscription periods unless required by law.
7. Intellectual Property Rights
All content, features, and functionality of Health.AI, including but not limited to text, graphics, logos, software, AI algorithms, and designs, are owned by Health.AI or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may NOT:
- Reproduce, distribute, or publicly display Health.AI content without written permission
- Reverse engineer, decompile, or disassemble our software or AI models
- Remove or alter any copyright, trademark, or proprietary notices
- Use our Services to build competing products or services
- Scrape, crawl, or automate access to our platform
8. Limitation of Liability
DISCLAIMER OF WARRANTIES: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Health.AI does not warrant that:
- The Services will be uninterrupted, secure, or error-free
- AI-generated health information will be accurate, reliable, or complete
- Any errors or defects will be corrected
- The Services are suitable for your specific health needs
LIMITATION OF LIABILITY:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEALTH.AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR HEALTH-RELATED DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, our liability will be limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you paid to Health.AI in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Health.AI and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:
- Your use or misuse of the Services
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your User Content
- Health decisions made based on information from Health.AI
10. Dispute Resolution & Governing Law
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
10.2 Dispute Resolution
In the event of any dispute, controversy, or claim arising out of these Terms, you agree to first contact us at legal@health.ai to seek an informal resolution.
If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive your right to participate in class action lawsuits or class-wide arbitration.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or prominent notice on our platform at least 30 days before the changes take effect. Your continued use of Health.AI after changes become effective constitutes your acceptance of the revised Terms.
12. Miscellaneous
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms constitute the entire agreement between you and Health.AI regarding the Services and supersede all prior agreements.
No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
